Aceto balsamico: il più celebre – quello per antonomasia – è certamente quello di Modena, ma un controverso pronunciamento della Corte di giustizia dell’Unione Europea stabilisce che ad essere tutelata da imitazioni e usi impropri è solo la denominazione Igp completa e non i singoli termini.
Il contenzioso giuridico ha origine da un intervento del Consorzio di Tutela dell’Aceto Balsamico di Modena, che chiede il ritiro dal mercato dei prodotti di un’azienda tedesca che utilizzavano il termine “Balsamico” e che – secondo il Consorzio – costituivano un caso di concorrenza sleale e mancato rispetto della legislazione Ue sulla tutela dei prodotti a denominazione d’origine (nel caso dell’Aceto Balsamico di Modena parliamo di una Igp – Indicazione geografica protetta). Il caso è finito di fronte alla Corte di Giustizia dell’Unione Europea, che ha dato ragione all’azienda tedesca e che ha stabilito – in data 4 dicembre 2019 – che a non poter essere utilizzata da altri è soltanto la denominazione Igp completa (“Aceto Balsamico di Modena”), mentre i singoli termini (compreso “Balsamico”) possono essere utilizzati da chiunque e in qualunque modo.
In una nota il Consorzio di Tutela dell’Aceto Balsamico di Modena ha espresso profonda delusione e ha commentato in questi termini il pronunciamento della Corte Ue: “nel corso degli ultimi anni la corte di Giustizia Europea ha mostrato un orientamento assai favorevole alla protezione delle specialità alimentari a Indicazione Geografica di alcuni Paesi membri. Tutto ciò faceva ben sperare in un orientamento protettivo anche nel caso dell’Aceto Balsamico di Modena. Purtroppo, però, con una decisione sorprendente, la Corte di Giustizia non si è schierata per la protezione del famoso aceto modenese, limitandosi ad affrontare in modo formale e molto riduttivo la complessa tematica della protezione delle DOP e delle IGP. Si tratta di una decisione che riteniamo totalmente ingiusta, a partire dall’assunto che la parola balsamico indichi ciò che invece non è: sappiamo tutti, in Italia e all’estero, che le caramelle e gli sciroppi ‘balsamici’, così come l’aggettivo ‘balsamico’ nella degustazione dei vini, non indicano assolutamente un sapore agrodolce, richiamando invece note forti e mentolate, che il nostro aceto di certo non possiede. La realtà è che molti Paesi Europei si sono voluti parzialmente appropriare del successo mondiale riscosso dall’Aceto Balsamico di Modena (questo sì, unico aceto ad essere agrodolce e a usare la parola Balsamico, solo perché gli venne attribuita molti secoli fa dai Duchi Estensi, che lo ritenevano medicamentoso) e cercano di imitarlo in modo massiccio usandone il nome. Probabilmente, il notevole peso di interessi politici e commerciali dei Paesi che si sono schierati ufficialmente contro il Consorzio e, d’altra parte, un sistema Italia che invece fatica a far valere le proprie istanze a livello comunitario, hanno contribuito a quest’esito a dir poco deludente“.
