Home restaurant: il controverso pronunciamento di un giudice di pace in Toscana ha riaperto l’annosa questione delle regole e autorizzazioni necessarie per avviare un’attività di Home Restaurant.
Il giudice di pace di San Miniato (Pi) ha accolto favorevolmente il ricorso di un cittadino del Comune di Montopoli (Pi), dopo che il Comune – avendo scoperto che il cittadino praticava di fatto attività di Home Restaurant – aveva cercato di bloccarlo con un’ordinanza per mancata Segnalazione certificata di inizio attività (Scia). Il giudice ha stabilito, in sintesi, che se l’attività non si trova nelle zone tutelate che sono indicate nella risoluzione del Mise 50481/2015 non è necessaria la Scia. Si definisce Home Restaurant, nell’ordinamento italiano, la “preparazione di pranzi e di cene presso il proprio domicilio in giorni dedicati e per poche persone, trattate, perlopiù, come ospiti personali ma paganti”.
Gaetano Campolo, presidente della più importante associazione di categoria (Home Restaurant Italia), ha commentato in questi termini la notizia: “questa sentenza rappresenta un importantissimo precedente e oltretutto è l’ennesima conferma per lo sviluppo del fenomeno del Social Eating sul territorio italiano. Chiunque ha la possibilità di poter avviare un Home Restaurant, un’iniziativa privata che permette la condivisione della passione per la cucina, il territorio e le tradizioni“.
Di tutt’altro avviso è invece Roberto Calugi, il direttore generale della Fipe (Federazione italiana pubblici esercizi), che ha chiarito il punto di vista degli esercenti e commercianti in questi termini: “chi intende aprire un’attività di home restaurant ha l’obbligo di presentare una Scia in Comune o di ottenere un’esplicita autorizzazione nel caso in cui voglia farlo in un’area tutelata. Questo è ciò che prevede il Ministero dello Sviluppo Economico ormai dal 2015, e chi dice il contrario dice una fake news. Il fatto che un giudice di pace di San Miniato si sia espresso in maniera opposta dimostra soltanto che la normativa si presta a interpretazioni diverse. Il Mise ha dunque il dovere di fare chiarezza una volta per tutte: non è possibile che migliaia di imprenditori della ristorazione non sappiano se chiunque può svegliarsi un mattino e fare loro concorrenza senza nemmeno dover dichiarare l’apertura dell’attività. È incredibile che si faccia passare il messaggio che una sentenza di un giudice di pace di provincia possa fare giurisprudenza a livello nazionale. Così non è e lo si impara al primo anno di Legge. Quello che a noi interessa, tuttavia, è che le regole siano chiare per tutti. Chi apre un home restaurant ha il dovere di comunicare l’avvio della propria attività, che deve poter essere controllata dalle autorità sanitarie, esattamente come tutte le altre: ne va della sicurezza dei consumatori. Non solo. In nome di un contrasto all’evasione fiscale a 360°, è necessario estendere anche agli home restaurant l’obbligo di dotarsi di pos per il pagamento con il bancomat. Il principio è semplice: stesso settore, stesse regole. Altrimenti è concorrenza sleale“.
